Swaps disclosure II

This document is not a written confirmation in accordance with article 33.1 of Royal Decree 217/2008 of 15 February on the legal regime of investment companies and other entities which provide investment services and for which there is a partial modification of the Regulation of Law 35/2003 of 4 November, of Collective Investment Institutions, approved by Royal Decree 1309/2005 of 4 November (in relation with article 2 of Law 24/1988 of 28 July of the Stock Market, nor in accordance with the Framework Contract in effect between ourselves, or which we both could sign in the future.

Written confirmation, including the definitive terms of the transaction, will be submitted to you shortly by post or fax. Until there is acceptance of the written confirmation by both parties, the only proof of the agreement between us will be the recording of the transaction carried out over the telephone, which, in the event of errors or discrepancy, will prevail over the details included in this document.

This document only includes a written approximation of the terms of the transaction agreed over the telephone; as such, neither Banco Bilbao Vizcaya Argentaria, S.A. nor the counterparty is bound by its content.
